Terms of Service

By accessing or using the Zynq AI platform (“Service”) at https://zynqai.in, you agree to be bound by these Terms of Service (“Terms”). If you are accessing the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not use the Service.

Zynq AI provides an AI-powered hiring platform that includes:

• AI resume screening and candidate ranking (ARGUS)
• Searchable talent pool (ORION)
• Pipeline management board (ATLAS)
• WhatsApp candidate outreach (PULSE)
• AI interview agent (VERO — coming soon)
• Voice calling agent (HERMES — coming soon)
• Analytics and reporting (LUMEN)
• Scheduling automation (CRON)

The Service is a B2B platform intended for placement agencies, HR teams, and employers. It is not intended for personal job seeking.

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at hello@zynqai.in if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms, are associated with fraudulent activity, or remain inactive for more than 24 months.

You agree that you will:

• Use the Service only for lawful hiring and recruitment purposes
• Obtain any consents required under applicable law before uploading candidate data to the platform (including consent obligations under India’s DPDP Act 2023 and equivalent laws in other countries)
• Not upload candidate data that you are not authorised to process
• Not use the Service to discriminate against candidates on the basis of religion, race, caste, sex, place of birth, or any other ground prohibited by Indian or applicable law
• Not reverse engineer, decompile, or attempt to extract the source code of the platform
• Not use automated scripts or bots to interact with the Service outside of our published API
• Not attempt to gain unauthorised access to any part of the Service or any other user’s data
• Not upload malware, viruses, or malicious files

The AI screening results produced by Zynq AI are recommendations, not decisions. You understand and agree that:

• All hiring decisions remain the sole responsibility of you, the recruiter or employer
• AI-generated scores and fraud flags are provided for human review and must not be relied upon as the sole basis for rejecting or advancing a candidate
• Zynq AI makes no warranty that AI screening results are accurate, complete, or free from bias
• You are responsible for ensuring your use of AI screening complies with all applicable employment and anti-discrimination laws in your jurisdiction

You retain ownership of all candidate data you upload to the platform. By uploading candidate data, you grant Zynq AI a limited, non-exclusive licence to process that data solely to provide the Service to you.

You confirm that you have a lawful basis to upload and process the candidate data you submit. You indemnify Zynq AI against any claims arising from your failure to obtain required consents or your unlawful use of candidate data.

We do not use candidate data to train AI models or share it with third parties except as described in our Privacy Policy.

Use of the PULSE outreach feature must comply with WhatsApp’s Business Policy and applicable laws regarding unsolicited commercial communications. You are solely responsible for ensuring that candidates have consented to receive WhatsApp messages from your agency before using the outreach feature.

Zynq AI and its licensors retain all intellectual property rights in the platform, including but not limited to the software, AI models, interface design, branding, and documentation.

You retain all intellectual property rights in the data you upload (job descriptions, screening criteria, notes, candidate files). You grant us only the limited licence described in “Candidate data” above.

Zynq AI is currently in an early-access phase. During this period, access may be provided free of charge or under a trial arrangement. Specific pricing plans (Scout, Recruiter, Bureau) will come into effect when the platform exits early access.

When paid plans are activated, we will provide at least 30 days’ notice before charging any fees. Paid plans are billed in advance. Refunds are not provided for partial periods unless required by law.

We reserve the right to change pricing with 30 days’ notice. Continued use after the notice period constitutes acceptance of new pricing.

We aim to maintain high availability but do not guarantee uninterrupted access to the Service. Planned maintenance will be communicated in advance where possible. We are not liable for losses arising from downtime or service interruptions.

To the maximum extent permitted by applicable law, Zynq AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of business, or reputational harm, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising out of or related to these Terms shall not exceed the amount you paid to Zynq AI in the 12 months preceding the claim.

Nothing in these Terms limits liability for death, personal injury, fraud, or any liability that cannot be limited under applicable law.

You agree to indemnify, defend, and hold harmless Zynq AI, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms
• Your violation of any applicable law, including employment and data protection laws
• Your unlawful processing of candidate data
• Any third-party claim arising from your use of the WhatsApp outreach feature

You may terminate your account at any time by contacting us at hello@zynqai.in. Upon termination, your access to the Service will end and your data will be deleted in accordance with our data retention policy (see the Privacy Policy).

We may terminate or suspend your access at any time if you breach these Terms, with or without notice.

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in India.

For users in Singapore, Malaysia, Indonesia, Philippines, or Vietnam, we will make reasonable efforts to resolve disputes through mediation before initiating formal proceedings.

We may update these Terms from time to time. Material changes will be communicated by email or via a notice on the platform at least 30 days before taking effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
